The Court also inquired about Plaintiffs' Motion to Sever Claims and Establish a Separate Procedural Track [Dkt. 8]. Plaintiffs confirmed that the motion seeks to remove Mr. Marrett as a plaintiff. The Court therefore construes it as a motion to voluntarily dismiss Mr. Marrett's claims. So construed, the motion is GRANTED, and Mr. Marrett is DISMISSED from this action."(JAM)

ORDER denying 5 MOTION FOR DISQUALIFICATION/RECUSAL OF MAGISTRATE JUDGE PURSUANT TO 28 U.S.C. § 455 AND FOR INTRADISTRICT REASSIGNMENT OF MAGISTRATE REFERRAL TO THE PORTLAND DIVISION. The Motion is DENIED. Pursuant to the District of Maine's Plan for District Wide Case Assignment, see section IV of the Plan, "Civil Cases will be randomly referred to the Magistrate Judge of this District without regard to location in which the case was filed."
