Order Dismissing Case
ENDORSED ORDER. Before the Court is Plaintiff's Response to Order to Show Cause or, Alternatively, Request for Dismissal Pursuant to Rule 41(a)(2) (Doc. 128). Counsel has diligently been working to identify and contact counsel for Amazon.com, Inc. to obtain a stipulation for the dismissal of EzriCare, LLC and EzriRx, LLC. "[I]f counsel are unable to acquire signatures from all parties who have appeared in the litigation, the Rules do not leave them without recourse. Should this situation arise, Rule 41(a)(2) still provides parties with an avenue for securing dismissals through court order. See Fed. R. Civ. P. 41(a)(2)." City of Jacksonville v. Jacksonville Hosp. Holdings, L.P., 82 F.4th 1031, 1039 (11th Cir. 2023). Accordingly, the case is dismissed with prejudice as to EzriCare, LLC and EzriRx, LLC pursuant to the Stipulation of Dismissal (Doc. 123).
