Order on Motion to Amend
Chief Judge F. Dennis Saylor, IV: ELECTRONIC ORDER entered. A party may amend its pleading once as a matter of course if done so within 21 days of serving it. Fed. R. Civ. P. 15(a)(1)(A). Here, defendant answered the complaint on January 10, 2022. He therefore had until January 31 to amend without seeking leave of the Court. On that date, he requested leave to amend the complaint. He then filed his proposed amendment on February 3. Although the amendment was filed late, it will nonetheless be allowed under Fed. R. Civ. P. 15(a)(1)(A) in light of the defendant's pro se status and lack of familiarity with the rules of procedure. And, in any event, the amendment may be granted pursuant to Fed. R. Civ. P. 15(a)(2). Under the circumstances, and considering the early stage of the case, the Court does not find that plaintiff is unduly prejudiced by the amendment. Accordingly, the motion to amend ECF No. 48 is GRANTED. (McKillop, Matthew)
