Dismiss Case
ORDER DISMISSING ACTION by Judge Fernando L. Aenlle-Rocha: On July 18, 2023, the court issued an Order to Show Cause why the action should not be dismissed for lack of subject matter jurisdiction due to an insufficient amount in controversy. Plaintiff has not filed any response to the court's OSC. Defendants David Olan and Olan Law Corporation filed a response on August 1, 2023. After ordering the parties to demonstrate diversity jurisdiction legally and factually, the amount in controversy and therefore the existence of diversity jurisdiction remains unproven and in substantial doubt. Accordingly, the court cannot conclude that diversity jurisdiction exists. The court, therefore, DISMISSES the action without prejudice. All dates and deadlines in this court are VACATED. Defendants Motion to Dismiss 13 is DENIED as MOOT. The clerk of the court shall close the action administratively. (Made JS-6. Case Terminated.) (lc) Modified on 8/15/2023 (lc).
