   ORDER: Plaintiff's former counsel, Linda Fedrizzi, has submitted a sealed application 69 for sealing an earlier application 64 by which she was relieved as counsel. There appears to be no legal basis for sealing either application. On the contrary, as Defendant writes in opposition 70 , Ms. Fedrizzi's motion to withdraw is not properly designated as "confidential" under the parties' stipulated Confidentiality Order 57 and it is a judicial document to which a common-law right of public access attaches. See Lugosch v. Pyramid Co. of Onondaga, 435 F.3d 110, 119-20 (2d Cir. 2006). Although motions to withdraw as counsel are often filed under seal to protect attorney-client privilege and the confidentiality of the attorney-client relationship, those concerns are not present here, where the rift described in the motion to withdraw reportedly happened in front of opposing counsel and was "apparent to all" at that time. ECF No. 64 . Moreover, the letter in question has been on the public docket for two months. Under the circumstances, I cannot find that presumption of continuing public access is overcome. Nor do I find that there is any basis for sealing the already-redacted letter motion requesting sealing 69 . Accordingly, the motion 69 is denied and the Clerk is respectfully directed to unseal the same filing, ECF No. 69 . Ordered by Magistrate Judge Clay H. Kaminsky on 7/31/2026. (MAS)
