(No. 1:25-cv-1260-JLT-CDB), it is HEREBY ORDERED: (1) any party that has not filed a "Consent/Decline of U.S. Magistrate Judge Jurisdiction" form in No. 1:25-cv-1260-JLT-CDB shall complete and file such form no later than 10/14/2026; (2) counsel for all parties in both actions shall file no later than 10/21/2026 a joint report addressing (i) the status of the parties' efforts to agree upon a consolidated third amended complaint in which all Plaintiffs allege cognizable claims against all existing Defendants; and (ii) the parties' positions as to whether an agreed-upon consolidated third amended complaint moots Plaintiffs' motion for joinder in No. 1:25-cv-0358-CDB and Defendants' motion to dismiss in No. 1:25-cv-1260-JLT-CDB. And it is FURTHER ORDERED that the operative scheduling order in No. 1:25-cv-0358-CDB (Doc. 106) is modified to the following extent: Non-Expert Discovery 11/06/2026; Expert Disclosure 11/20/2026; Rebuttal Expert Disclosure 12/18/2026.
