ORDER re 109 Motion for Default Judgment. On May 24, 2019, the Clerk entered default against CP Grill Corp. for the first time. See Dkt. No. 10. On May 26, 2023, the Clerk of Court entered default against Defendant CP Grill Corp. for a second time. See Dkt. No. 75. The 75 Certificate of Default was previously served on Defendants on September 15, 2023 in connection with Plaintiffs 81 Motion for Default Judgment. (See [81-3] Exhibit Clerk's Cert. of Default, 83 Aff. of Service.) Plaintiff only attached the 10 Certificate of Default against CP Grill Corp. to her pending 109 Motion for Default Judgment. Because Plaintiff did not also attach the 75 Certificate of Default, Plaintiff is ordered to serve Defendants with the 75 Certificate of Default by August 21, 2026 and to file proof of service immediately thereafter. Scheduling Order
SCHEDULING ORDER: The Court is in receipt of Defendant Eustis Cable Enterprises, Ltd. ("Eustis") and Plaintiff's 64 66 67 briefing regarding Defendant Eustis' motion to dismiss for lack of personal jurisdiction. In light of the Second Circuit's recent decision in Northwell Health, Inc. v. Grp. Hospitalization & Med. Servs., Inc., No. 25-192, --- F.4th ----, 2026 WL 2035965, at *6-10 (2d Cir. July 15, 2026), the parties are granted leave to file limited supplemental briefing addressing whether the decision is relevant to the present personal jurisdiction dispute. Plaintiff shall file a letter of no more than two pages by August 31, 2026 addressing the Northwell decision, or indicating if it believes the decision to be irrelevant here. Defendant Eustis shall file a response, if any, of no more than two pages no later than September 8, 2026. Ordered by Judge Pamela K. Chen on 8/18/2026. (MBH)
