MINUTE ORDER IN CHAMBERS of the Honorable Magistrate Judge Elayna J. Youchah on 6/26/2026.
The Court has before it the Stipulation to Extend Time (ECF No. 25 ) through which the parties seek an extension of discovery for the second time. The Stipulation shows very little discovery has occurred in this case and the parties believe they cannot complete discovery before a settlement conference set for the end of July. The parties do not establish diligence or good cause for the extension they seek. Moreover, the parties appear to suggest they are being compelled to attend a settlement conference before discovery is completed.
Accordingly, IT IS HEREBY ORDERED that the Stipulation to Extend Time (ECF No. 25 ) is DENIED without prejudice.
IT IS FURTHER ORDERED that the parties must file a joint status report no later than July 7, 2026 (1) addressing whether they wish to reschedule the settlement conference for a date in the fall after more discovery is completed, which the Court will accommodate, or (2) stating they want to proceed with the settlement conference set for July 22, 2026, and certifying that they have, or will have before that date, discussed settlement, exchanged initial offers and, in good faith, believe a settlement conference will likely lead to resolution. The parties must also address the reasons why more discovery has not taken place to date and provide plan for completing discovery during the extension requested.
