Order on Motion to Stay
MINUTE ORDER: This matter is before the Court on the parties' Joint Motion for Stays and Extensions of Time, ECF No. 22 , which was referred in part to this Court by Judge Crews, the presiding district court judge. ECF No. 23. Judge Crews granted the motion to the extent of staying the defendants' deadline to respond to the complaint until after the pending motion for preliminary injunction is involved and setting an extended briefing schedule for the preliminary injunction motion. Judge Crews referred the parties' request to stay the Fed. R. Civ. P. 16(b) Scheduling Conference, currently scheduled for November 5, 2026, until the resolution of the preliminary injunction motion. Id. The parties "expect that... resolution of the preliminary injunction motion may affect future Rule 16(b) deadlines, including joinder of parties, amendment of pleadings, discovery, pretrial conferences, and trial" and "may affect the parties' discussions of matters contemplated by Rule 16(b). Id. at 3-4. For good cause shown, and upon consideration of the factors enunciated in String Cheese Incident v. Stylus Shows, Inc., No. 02-cv-01934-LTB-PAC, 2006 WL 894955, *2 (D. Colo. Mar. 30, 2026), the Joint Motion for Stays and Extension of Time, ECF No. 22 , is GRANTED to the extent that the November 5, 2026 Scheduling Conference and associated deadlines are VACATED and STAYED until the resolution of preliminary injunction motion. A stay pending the resolution of preliminary injunction motion will not prejudice the plaintiffs nor burden the defendants, will avoid burdening the parties with the costs of preparing for and attending a scheduling conference before it would be beneficial, promotes judicial economy and efficiency, has no impact on nonparties, and is in the public interest. Within 5 days of the resolution of the preliminary injunction motion by the district court judge, the parties should jointly contact chambers by email at Chung_Chambers@cod.uscourts.gov to request setting of a Scheduling Conference. ORDER granting in part 22 Joint Motion for Stays and Extension of Time. The deadline for Defendants to respond to the Complaint is STAYED until after the Court has resolved Plaintiffs' Motion for Preliminary Injunction.
Defendants shall file their response to the Motion for Preliminary Injunction on or before November 20, 2026. Plaintiffs shall file their reply on or before December 18, 2026.
The Court REFERS the request to stay the Scheduling Conference to Magistrate Judge Chung.
