ORDER OF DISCONTINUANCE: The Court having been informed that the parties have reached an agreement in principle to resolve this action, and the parties having consented pursuant to 28 U.S.C. § 636(c) to the undersigned exercising jurisdiction over this matter and conducting all proceedings herein, it is hereby ORDERED that: This action be, and hereby is, discontinued with prejudice and without costs, provided, however, that within 30 days of the date of this Order, if the parties' written documentation of the settlement is not completed, Plaintiff may apply by letter for the restoration of the action to the active calendar of the Court. ORDER granting 61 Letter Motion for Extension of Time to move for leave to join an additional party, to the following extent: As discussed in a telephone conference with the Court on 9/4/14, the parties are to proceed to their scheduled mediation on 9/8/14. If the mediation is not successful in resolving this action, then all counsel are to confer and submit a joint letter to the Court, within one week of the conclusion of the mediation, with a proposed modification of the schedule for discovery and any motion for joinder.
