Minute Order by Judge Jinsook Ohta: The Court GRANTS Plaintiff's request for a Rule 104 hearing regarding the admission of the executive summary of the Navy Command Investigation at trial and SETS the hearing for May 15, 2024 at 9:30 AM. See Fed. R. Evid. 104.
Regarding Plaintiffs request to admit the entirety of this report, the Court previously ruled during the motion in limine hearing that it will not admit the entire United States Navy Command Investigation into the Fire Aboard USS Bonhomme Richard (Dkt. 52-7) into evidence. The Court instructed Plaintiff that he must identify specific portions of the report that he wishes to enter in order for the Court to determine whether the identified portions are admissible.
The Court ORDERS Plaintiff to file any further briefing on this issue by Wednesday May 8, 2024. If Defendant wishes to file opposition briefing, it must do so by Monday May 13, 2024. Signed by Judge Jinsook Ohta on 05/03/2024.(cem) -
