The Court makes preliminary remarks and hears from counsel as to the 35 Motion for Attorneys Fees under the Equal Access to Justice Act.
The Court sets forth findings of fact and conclusions of law on the record. For the reasons set forth on the record, the Court finds Federal Respondents' position was not substantially justified and Petitioners are entitled to costs and reasonable attorney's fees at the adjusted statutory maximum hourly rate.
IT IS ORDERED Petitioners' 35 Motion for Attorney's Fees and Costs under the EAJA is GRANTED. The Court awards $ 15,093.95 in fees and $ 255.00 in costs. The judgment shall be amended to include fees and costs in the amount of $ 15,348.95 awarded to Petitioners.
Given Petitioners' counsel's limited resources, IT IS FURTHER ORDERED Federal Respondents shall pay the awarded fees and costs within 60 days.
The Court will not issue a separate written ruling. The instant minutes of proceedings and minute order(s), which incorporate by reference the transcript of the hearing and the reasoning therein, shall serve as the final order of the Court.
