TEXT ORDER: The parties joint letter application 21 is granted in part and denied in part. The Court will enter an order referring this case to court mediation. Counsel shall follow the instructions for selecting a mediator and completing mediation. Any motion practice is stayed to allow the parties to make a good faith effort during the mediation process. Should mediation not prove successful, then the parties can submit an agreed upon modified briefing schedule as to defendant's motion to dismiss.
