Order on Motion to Reopen
ORDER with respect to 59 Letter Motion to Reopen re: 58 Order , approve settlement, and dismiss case retaining jurisdiction to enforce the parties' settlement in this FLSA action, addressed to Judge Kenneth M. Karas from Peter Hans Cooper dated December 20, 2023. The Settlement Agreement is devoid of "an actual bottom-line statement of the dollar amount that each of the named plaintiffs would receive from the proposed settlement. This omission... leaves the Court in a position in which it cannot discharge its duty to determine whether the settlement amount is fair and reasonable as to each of the named plaintiffs." Lopez v. Nights of Cabiria, LLC, 96 F.Supp.3d 170, 177 (S.D.N.Y. 2015). The parties are directed to file an Amended Settlement Agreement by April 30, 2024, which includes the amount each Plaintiff would receive from the proposed settlement. SO ORDERED.
