Order on Motion to Stay
TEXT ORDER granting in part the parties' 19 joint motion to stay. The parties jointly request a stay of the proceedings in this action until November 7, 2026, pending the outcome of a mediation scheduled for October 8, 2026. (ECF No. 19 ). The parties "agree that a stay will not adversely affect any party and will provide an opportunity to resolve all matters related to the allegations in this case." Id. The court finds this motion is meritorious and should be granted in part. As such, the court hereby STAYS this litigation pending the outcome of the mediation. See PBM Nutritionals, LLC v. Dornoch Ltd., 667 F. Supp. 2d 621, 631 (E.D. Va. 2009) ("[T]he court has wide discretion to weigh competing interests and maintain an even balance" when considering a motion to stay) (internal quotations omitted); United States v. Georgia Pac. Corp., 562 F.2d 294, 296 (4th Cir.1977) ("The determination by a district judge in granting or denying a motion to stay proceedings calls for an exercise of judgment to balance the various factors relevant to the expeditious and comprehensive disposition of the causes of action on the court's docket."). The parties shall submit a status report to the court by October 15, 2026. If the parties are unsuccessful at the mediation, the status report shall include a proposed amended scheduling order. In the event the parties resolve the claims before then, the parties shall immediately notify the court. IT IS SO ORDERED.
