Order on Motion to Withdraw as Attorney Status Report Order Scheduling Order
ORDER re 109 : Motion to withdraw GRANTED. James Montgomery terminated as counsel of record for C.H. Supermarket, Inc., L.X.W.H.C., Supermarket Inc., "Ah-zhen" (first name unknown) Wu, Peng Wu, He Huang, and "John" (first name unknown) Lin. Said defendants shall have until 06/24/2024 to find new counsel or, in the case of the individually named defendants, inform the Court of their intent to proceed pro se. Failure to meet this deadline will result in entry of default.
Mr. Montgomery's request to file an Amended Answer on behalf of his remaining clients, Xiao-Cheng Lin and CL Supermarket Inc., is DENIED at this time. Said defendants are ORDERED to serve plaintiffs with a proposed Amended Answer by 05/30/2024. By 06/06/2024, plaintiff shall notify this Court and counsel if they have any objections to the proposed amendments. If not, the Amended Answer may be filed on consent; if there are objections, then defendants are directed to file a formal motion to amend.
Mr. Montgomery is ORDERED to promptly serve a copy of the attached order on the defendants and to file proof of service immediately thereafter.
