Order on Motion to Amend/Correct/Modify
MINUTE ORDER: : The defendant's Unopposed Motion to Amend Caption, ECF No. 13 , is DENIED without prejudice. The motion offers no legal authority for the requested relief, and a motion to amend a caption generally would be brought by a plaintiff under Fed. R. Civ. P. 15, which allows a party to amend "its" pleading. See, e.g., Bachor v. Bd. of Cnty. Comm'rs of La Plata Cnty., No. 21-cv-02276-LTB-NRN, 2023 WL 2824364, at *4 (D. Colo. Mar. 15, 2023); Thomas v. O'Conner, No. 09-cv-01748-MSK-KMT, 2010 WL 2794060, at *2 (D. Colo. July 14, 2010); see also Toll Bros., Inc. v. Gu, No. 25-cv-02884-PAB-CYC, 2026 WL 207416, at *1 (D. Colo. Jan. 27, 2026) (construing stipulation signed by plaintiff and counterclaim defendant as a motion brought under Fed. R. Civ. P. 15(a)(2)). The Court is not aware of authority allowing a defendant to seek to amend a pleading filed by another party. Entered by Magistrate Judge Cyrus Y. Chung on 06/11/2026. Text Only Entry.(agryan)
