ORDER: Defendant TFG Financial Corp. responds to the Court's 7/8/2026 Order to Show Cause by clarifying that it is a citizen of Canada, not New York, and by asking for permission to amend its notice of removal to that effect. When a pleading contains an "incorrect statement[] about jurisdiction that actually exists," courts may provide leave to amend it pursuant to 28 U.S.C. § 1653. LeBlanc v. Cleveland, 248 F.3d 95, 99 (2d Cir. 2001) (quoting Newman-Green, Inc. v. Alfonzo-Larrain, 490 U.S. 826, 831 (1989)); see also Mente v. Wastequip, Inc., No. 10-CV-315, 2010 WL 11681516, at *2 (N.D.N.Y. July 16, 2010). The Court is satisfied, in light of defendant's response to the Order to Show Cause, that there is complete diversity between the parties and that subject matter jurisdiction actually exists. Defendants' 5 motion to amend its notice of removal is granted, and the Order to Show Cause is discharged. Ordered by Judge Rachel P. Kovner on 7/23/2026. (ASG)
