ORDER (Memorandum filed previously as separate docket entry 17 ) - AND SO, on this 10th day of June 2026, upon consideration of Defendants partial motion to dismiss (Doc. No. 5 ) Plaintiffs complaint (Doc. No. 1-2), and in accordance with the accompanying Memorandum, IT IS ORDERED THAT: 1. Defendants partial motion to dismiss (Doc. No. 5 ) is GRANTED; 2. The Section 1983 loss of consortium claim asserted against both defendants (Count V) is DISMISSED WITH PREJUDICE and the Section 1983 claim alleging negligent supervision and failure to train against Defendant NYRPD (Count IV) is DISMISSED WITHOUT PREJUDICE; and 3. Within twenty-one (21) days of the date of this Order, Plaintiffs may file an amended complaint to attempt to address the pleading deficiencies identified in the accompanying Memorandum as to Count IV of the complaint.
