MEMORANDUM OPINION AND ORDER: For the reasons stated in the attached opinion, Defendant's Motion for Summary Judgment 5 is GRANTED to the extent that Count III of the Complaint 1 is DISMISSED with prejudice, but the motion is otherwise DENIED. It is further ORDERED that Defendant shall respond to Plaintiff's Complaint 1 on or before October 6, 2026. See Fed. R. Civ. P. 12(a)(4)(A). And it is further ORDERED that Plaintiff's counsel shall show cause on or before October 6, 2026 why he should not be sanctioned for including incorrect and misleading citations and quotations in Plaintiff's Opposition 7 to Defendant's Motion for Summary Judgment 5 . In his show-cause submission, Plaintiff's counsel shall (1) include a list of all cited authorities in the opposition brief, along with an explanation whether each citation or quotation is substantiated by the underlying case; (2) a description of what caused any errors to appear in the filed brief, including whether counsel used generative artificial intelligence when drafting; and (3) a statement about what sanction, if any, would be appropriate for the court to impose.
