Order on Motion for Miscellaneous Relief
ORDER denying 207 Motion for Case Management Order/Order Barring Certain Participation. Plaintiffs Motion For Case-Management Order Regarding Participation/Attendance of Name Individual Defendant Scott Andreassi 207 is DENIED. A conflict of interest for a participating attorney is defined by the Pennsylvania Rules of Professional Conduct. See United States v. Bellille, 962 F.3d 731, 738 (3d Cir. 2020). Where a party seeks to disqualify the representation of an adversarys attorney, they bear the burden of showing that the attorneys continued representation violates a rule of professional conduct. See Holcombe v. Quest Diagnostics, Inc., 675 F. Supp. 2d 515, 518 (E.D. Pa. 2009). Plaintiffs have not successfully borne their burden here. When considering the ends that the disciplinary rule is designed to serve, United State v. Miller, 624 F.2d 1198, 1201 (3d Cir. 1980), Mr. Andreassis actions do not present a conflict of interest, because his interests as an individual Defendant and his interests as the solicitor for another defendant do not at this point appear to be unaligned and the Moving Parties have not demonstrated otherwise, See Pa.
