Minute Order Order on Motion to Substitute Attorney
MINUTE ORDER IN CHAMBERS of the Honorable Magistrate Judge Nancy J. Koppe on 7/29/2026. Pending before the Court is a motion to substitute defense counsel. Docket No. 52 . In contravention of the local rules, the motion is not signed by the client. Local Rule IA 11-6(c). In addition, given the upcoming trial date, any renewed request to substitute must state explicitly that incoming counsel would not require modification of the current case schedule. IT IS SO ORDERED. (Copies have been distributed pursuant to the NEF - TM)
MINUTE ORDER IN CHAMBERS of the Honorable Magistrate Judge Elayna J. Youchah on 7/29/2026. By Law Clerk: S. Gorba.
Before the Court is the Motion to Substitute Attorney (ECF No. 168 ), which does not comply with the Court's local rules. Under LR IA 11-6(c) "[a] stipulation to substitute attorneys must be signed by the newly-appearing attorneys, the withdrawing attorneys, and the represented client and be approved by the court." Further, LR IA 6-2 states in pertinent part that "[a] stipulation or ex parte or unopposed motion must include an 'order' in the form of a signature block on which the court or clerk can endorse approval of the relief sought." Because the pending motion was not signed by the represented client and does not include a signature block for the Court,
IT IS HEREBY ORDERED that the Motion to Substitute Attorney (ECF No. 168 ) is DENIED without prejudice.
