MINUTE ORDER IN CHAMBERS of the Honorable Judge Miranda M. Du on 9/16/2026. Deputy Clerk: D. Santiago.
The Stipulation to Continue the Hearing on the Motion to Strike and Objection/Appeal Magistrate Judge Order (ECF No. 60 ) is granted in part. The hearing scheduled for September 25, 2026, at 9:00 a.m. is vacated. The Court will reschedule the hearing on the remaining motion at a later date.
Having fully reviewed Plaintiff's appeal of the Magistrate Judge's order (ECF No. 51 ) and the related filings in preparation for the scheduled September 25, 2026 hearing, the Court finds a hearing is not needed. The Court finds the Magistrate Judge's order (ECF No. 50 ) denying Plaintiff's renewed motion for sanctions of spoliation of evidence (ECF No. 42 ) in part and granting it in part is not clearly erroneous or contrary to law. See LR IB 3-1(a); see, e.g., Grimes v. City & Cnty. of San Francisco, 951 F.2d 236, 240 (9th Cir. 1991) (the court reviews a magistrate judge's factual findings under the 'clearly erroneous' standard and their legal conclusions under the 'contrary to law' standard). Accordingly, the Court overrules Plaintiff's appeal [ECF No 51 ] and affirms the Magistrate Judge's order (ECF No. 50 ). The Court will further explain its ruling orally at the continued hearing on the remaining pending motion to strike.
