MINUTE ORDER. The Court's prior Order, Dkt. 54 , granted plaintiff's motion for leave to file a supplemental expert report. It permitted defendant 40 days to depose Dr. Sawyer on his additional opinions, to prepare a rebuttal expert report, and/or to file a Daubert motion regarding Sawyer's supplemented report. The purpose was to address the prejudice Monsanto identified in its response to Kooi's motion to supplement. Dkt. 49 at 9. There is now room in the schedule for an extension of this time, if necessary. There is also time for plaintiff to depose Monsanto's expert on any rebuttal opinions, and to file its own Daubert motion, within 40 days of the receipt of any supplemental expert rebuttal report. The Court's Order informed the parties that it would not consolidate the summary judgment hearings in the three related cases (Kooi, Toyer, and Huntley) but that it would consider the motions consistently. It struck the trial date and all other associated pretrial deadlines, pending the resolution of the Court's proposal to consolidate the three cases for liability and to then bifurcate (or trifurcate) the cases for separate damages trials, if necessary. Plaintiff's motion for leave to file a surreply in opposition to defendant's summary judgment motion, Dkt. 53 , is unopposed and it is GRANTED. IT IS SO ORDERED. Authorized by Judge Benjamin H.
