Because Plaintiff will be filing a SAC, the [ECF 22 ] SH Group Hotels & Residences U.S., LLC., SOF-XI Kauai PV Hotel, L.P., SOF-XI Kauai PV Golf, L.P.'s Motion to Dismiss First Amended Complaint [ECF 10] for Lack of Subject Matter Jurisdiction ("Motion to Dismiss") is rendered MOOT, WITHDRAWN and TERMINATED WITHOUT PREJUDICE.
Parties confirm agreement to explore private mediation with Meditator Keith Hunter.
To monitor status, the Rule 16 Scheduling Conference scheduled for 10/21/2026 at 9:30 a.m. before Magistrate Judge Trader to remain on calendar. Scheduling Conference Statements are due 10/14/2026. Parties to be prepared to discuss setting dates or possibly a limited stay or administrative closure to permit mediation to proceed.
