MINUTE ORDER by Magistrate Judge Jason A. Robertson: A review of the record in this case reveals that Defendant Cyber Enviro-Tech, Inc. was advised to obtain alternative legal counsel by June 12, 2026, since a corporation cannot appear pro se in litigation. To date, this Defendant has not complied with this Court's Order. Accordingly, Defendant Cyber Enviro-Tech, Inc. shall secure legal counsel and have that counsel file an Entry of Appearance no later than SEPTEMBER 11, 2026. THE FAILURE TO COMPLY WITH THIS ORDER SHALL RESULT IN THE SETTING OF AN IN-PERSON HEARING FOR THIS DEFENDANT TO APPEAR AND SHOW CAUSE AS TO WHY A DEFAULT JUDGMENT SHOULD NOT BE ENTERED AGAINST IT AND WHY ITS COUNTERCLAIM SHOULD NOT BE DISMISSED. See Watchous Enters., LLC v. Pac. Nat'l Cap., No. 16-1432-DDC, 2021 WL 1998932, at *1 (D. Kan. May 19, 2021) citing Shapiro, Bernstein & Co. v. Continental Record Co., 386 F.2d 426, 427 (2d Cir. 1967) (holding plaintiffs were entitled to default judgement against pro se corporate defendant where defendant repeatedly disregarded instructions from the court to secure legal counsel (citing Fed. R. Civ. P. 55(a))); see also Fed. R. Civ. P. 55(a) ("When a party against whom a judgment for affirmative relief is sought has failed to plead or otherwise defend... the clerk must enter the party's default.").(tjm, Deputy Clerk)
