TEXT ORDER - The Court is in receipt of Plaintiff OxyChem NY/ERH's request for leave to file a Motion to Consolidate a related action, BASF Catalysts LLC v. Occidental Chemical Corp,, 26-cv-1226 (MCA), into this stayed action, as well as Defendants' opposition. (ECF 2435 , 2437 , 2441 ). Another OxyChem entity has moved to dismiss the BASF Catalysts action in its entirety under Rules 12(b)(1), 12(b)(6), and 19 of the Federal Rules of Civil Procedure. The Court finds that the proposed Motion to Consolidate is premature prior to resolution of the pending Motion to Dismiss in BASF Catalysts, and Plaintiff's application is therefore denied without prejudice.
