The parties are ORDERED to file on or before April 29, 2024 briefs of no more than 10 pages addressing the impact of the Court of Appeals' decisions in Da Costa v. Immigration Investor Program Office, 80 F.4th 330 (D.C. Cir. 2023) and Mukkavilli v. Jaddou, No. 23-5138, 2024 WL 123146 (D.C. Cir. March 22, 2024) on the motion to dismiss. The briefs should address the question of whether this Court can and should accept as true for the purposes of this motion to dismiss the conclusions of the Court of Appeals that USCIS applies a rule of reason by "processing Form I-526 petitions from nationals of countries as to which visas are currently available in the order in which those petitions were received" and that granting relief "would involve disfavored line-jumping." Da Costa, 80 F.4th at 339, 341. It is further ORDERED that the case is stayed in the meantime. So ORDERED by Judge Carl J. Nichols on March 29, 2024. (lccjn2)
