Plaintiffs fail to state a claim under the IDCEMA to the extent they seek to hold Ulta liable for emails that contain "false" in formation in the subject line. This claim is DISMISSED without prejudice. Plaintiffs' conspiracy claim is preempted by the CAN-SPAM Act's Preemption Clause. This claim is DISMISSED with prejudice.
