Status Report Order Scheduling Order
ORDER: The Court conducted a telephonic hearing as to Attorney Yenisey Rodriguez-McCloskey's motion to withdraw as counsel for Defendant Albert Basalmashhadi. ECF No. 133 . Counsel for Plaintiff did not attend the hearing.
Prior to the hearing, the parties were ordered to file a discovery status letter by 8/18/2026 indicating if discovery is concluded or identifying any remaining discovery issues. See 8/5/2026 Order. The parties filed a joint status report, but it is unclear from this report whether discovery is concluded or if discovery issues remain. ECF No. 132 .
On or before 10/16/2026, the parties shall file another joint status report. Attorney Yenisey Rodriguez-McCloskey is expected to participate in the preparation of the joint status report. The report must outline current and next steps in this case, as they pertain to Defendant Albert Basalmashhadi. The report should discuss the status of discovery and motion practice, whether any dispositive motions are anticipated and if they would be timely, whether the parties are interested in mediation or intend to go to trial, and the effect of the pending appeal on the remaining claims against Defendant Albert Basalmashhadi.
On or before 11/6/2026, Defendant Albert Basalmashhadi and Attorney Yenisey Rodriguez-McCloskey shall meet in person and file a joint letter to update the Court on the issues raised during the 9/30/2025 telephonic hearing, if they are able to reach a mutually agreed upon resolution. If they are unable to reach such a resolution upon meeting in person, by the same date, Attorney Yenisey Rodriguez-McCloskey shall update her motion to withdraw, and Defendant Albert Basalmashhadi shall file a separate letter regarding his position. The Court shall determine whether an in-person hearing with counsel for Plaintiff, Defendant Albert Basalmashhadi and Attorney Yenisey Rodriguez-McCloskey is necessary at that time.
