TEXT ORDER. A discovery conference was held with counsel regarding certain issues, including extending the discovery deadlines and the proper procedure for dealing with sensitive medical records. As indicated at the conference, on or before July 10, 2026, the parties shall jointly submit to the Court a proposed confidentiality order. That order will allow certain documents to be designated as "attorneys eyes only" ("AEO"). Counsel are reminded that an AEO designation requires the attorney seeking such a restriction to establish good cause. See Austin v. Fordham University, 2024 WL 749636 *3 (S.D.N.Y. 2024). In the case of a dispute, the document will be provisionally designated as AEO, subject to a court ruling. Next, the Court directs that Plaintiff's counsel provide to defense counsel the medical records which Plaintiff presently possesses, and any necessary authorizations. This production should also occur on or before July 10, 2026. Insofar as a court order, or court issued subpoena, is necessary to obtain Plaintiff's counseling records, counsel should submit a proposed order or subpoena for my signature on or before July 10, 2026. Regarding the issue of unreadable text messages sought by Defendants, Plaintiff's counsel will work with defense counsel to provide those text messages in an easily accessible form by the July 10th date. Finally, at the joint request of the parties, the discovery and dispositive motion deadlines are hereby extended. The end date of discovery shall now be November 30, 2026, and the date to file dispositive motions is set for January 29, 2027. Mediation shall be completed on or before August 31, 2026.
