Minute entry for proceedings held before Magistrate Judge Diana Song Quiroga. Initial Scheduling Conference held on August 17, 2026. Plaintiff appeared via Zoom through counsel James Ramsey and Defendant appeared via Zoom through counsel Zeke Moya. As a preliminary matter, the Court admonished Mr. Ramsey for his being nearly 30 minutes tardy to the proceedings, and Mr. Ramsey offered his apologies to the Court and to opposing counsel. The Court ordered Mr. Ramsey to compensate opposing counsel for his time spent waiting for Mr. Ramseys late arrival.This case is about an 18-wheeler accident. Defendants are Mexican nationals, and the driver has not been located yet, which Mr. Ramsey notes will require jumping through hoops. The Court inquired as to whether the driver is still employed by Defendant, but defense counsel was unsure. The Court suggested defense counsel determine whether driver is still employed and whether the company can accept service on his behalf. The Court encourages counsel to meet and discuss service issues and see if long delays can be avoided. The Court sets a date of September 8 for defense counsel to file an advisory with the Court on the status of Defendant Almanza: his employment status, his whereabouts, and plans to serve him. As to the Scheduling Order, the Court largely adopted the proposed Scheduling Order jointly offered by the parties. Dkt. No. 9. The Court, in encouraging the parties to take advantage of Court-hosted mediation, suggested they set an opt-in deadline for Court-hosted mediation. This deadline was set for August 2, 2027the same day as the discovery deadline.The Court and the parties discussed the needs of this litigation and discussed how those needs impacted pretrial management. After considering those needs, the Court and the parties adopted deadlines for each pretrial event. The Court will issue a scheduling order based on those deadlines.
