The parties advised the Court that they are continuing to review the documents produced by the Department of Defense (DoD) pursuant to the August 2024 subpoena. On or before 10/01/26, the parties shall file a joint status report updating the Court on their review of the DoD's production. The expert discovery schedule set on 7/7/26 220 shall stand. The parties shall file an updated joint status report by 11/13/26 that includes the following information: (1) confirming that the parties are on track with expert discovery; and (2) addressing whether the parties are interested in scheduling a settlement conference with the Court. Violation of these prohibitions may result in sanctions, including removal of court-issued media credentials, restricted entry to future hearings, denial of entry to future hearings, or any other sanctions deemed necessary by the Court.
