Order on Motion to Dismiss
TEXT ORDER: The Court is in receipt of Letter filed by Defendant AbbVie on April 3, 2024, (ECF No. 34 ), requesting that the Court first address the threshold issue of fraudulent joinder presented in Defendant AbbVie's Notice of Removal, (ECF No. 1 ), and Plaintiff's Opposition to Defendant Velocity Wellness's Motion to Dismiss, (ECF No. 24 ), which Defendant AbbVie refers to as a Motion to Remand. The Court notes that, to date, it has not received a Motion to Remand filed by Plaintiff. However, Defendant AbbVie filed a Letter on March 6, 2024, explaining that Plaintiffs Opposition essentially constitutes a motion for remand and requesting an opportunity to respond (ECF No. 25 ). This Court granted Defendant AbbVie's request, and on March 14, 2024, Defendant AbbVie filed a "Response" to Plaintiff's Opposition to Defendant Velocity Wellness's Motion to Dismiss, constru[ing] the opposition as a motion to remand. (ECF No. 31 ). The Court likewise construes Plaintiff's Opposition to Defendant Velocity Wellness's Motion to Dismiss, (ECF No. 24 ), as a Motion to Remand and finds it appropriate to address the threshold issue of fraudulent joinder before considering Defendant Velocity Wellness's Motions to Dismiss. Accordingly, the Motions to Dismiss pending at ECF Nos. 21 and 33 are administratively terminated pending the Court's resolution of Plaintiff's Motion to Remand.
