ORDER re: Discovery Dispute Conference held 9/24/2026. Plaintiff's Rule 30(b)(6) deposition of ThredUp's designee shall be rescheduled at the earliest mutually available dates and shall proceed in person over two days. The deposition shall be completed before ThreadUp takes Plaintiff's Rule 30(b)(6) deposition, even if that means rescheduling those depositions. Counsel for the parties are herein ORDERED to confer promptly and in good faith to identify dates consistent with these requirements. Plaintiff also requests an additional three hours of deposition time, for a total of fourteen hours over two days. The Court finds that request excessive under the circumstances. Nevertheless, in light of the issues that arose surrounding the previously scheduled deposition, the Court will permit Plaintiff one additional hour beyond the time previously allotted. Plaintiff therefore may depose ThreadUp's Rule 30(b)(6) representative for a total of twelve hours over two consecutive days. Finally, the Court emphasizes that the events giving rise to the present dispute are not to be repeated. If an issue arises during the rescheduled deposition that counsel cannot resolve after a meaningful good-faith effort, counsel must contact the undersigned before suspending or terminating the deposition, ending the deposition for the day because of the dispute, or leaving the deposition location. Absent extraordinary circumstances making consultation with the Court impossible, neither party may unilaterally terminate the deposition based upon a discovery dispute without first seeking the Court's assistance.
