PAPERLESS NOTICE. A CASE MANAGEMENT CONFERENCE is scheduled for August 5, 2026 at 4:00 p.m. Instructions to join the call will be provided. The call will be recorded, so please do not use speakerphones as they compromise sound quality. Also, we ask that parties not remain on the conference line after the Judge has left the call, to ensure that the line is free for other calls that may be on the Judge's calendar. The parties should also be prepared to address whether they consent to have all further proceedings before a Magistrate Judge and whether they wish to participate in a mediation session with a Magistrate Judge, whether before, during, or after discovery. Parties are expected to consult with their clients and confer with each other on these issues in advance of the Case Management Conference and, if possible, present joint views to the Court. MINUTE ORDER. The appellant's opening brief in this appeal was due March 1, 2026. See February 2, 2026 Minute Order. Upon granting the appellant's 6 Second Motion for Extension of Time, the Court set a new deadline of May 18, 2026, and stated that it was not inclined to grant any further extensions. See May 4, 2026 Minute Order. As of today, the appellant has yet to file her opening brief or move for an extension of time to do so. The appellee filed a 7 Motion to Dismiss this appeal on May 28, 2026, in light of the appellant's failure to file, to which the appellant has 8 moved for an extension of time to file a response thereto.
Under Bankruptcy Rule 8018(a)(4), the Court may, with notice, dismiss an appeal for the appellant's failure to file a brief on time without an extension. Rather than have the appellant, who has faced extraordinary health challenges, respond to the appellee's 7 Motion to Dismiss for failure to file, it is ORDERED that the appellant file her opening brief on or before August 2, 2026. The Court will not grant any further extensions of this deadline. Failure to file the opening brief on or before August 2, 2026, will result in dismissal of this appeal pursuant to Rule 8018(a)(4).
