   ORDER denying 105 Letter Motion for Leave to File Document. Plaintiff Wells Fargo Bank, N.A. ("Wells Fargo") and Defendant JPMorgan Chase Bank, N.A. ("JPMorgan") both seek leave to file cross-motions for summary judgment on Count 1, Wells Fargo's claim for breach of contract against JPMorgan. See ECF Nos. 105, 106, 110, 112.Wells Fargo also seeks leave to file a motion for summary judgment on Count 5, its claim for breach of contract against Defendant Meyer Chetrit. See ECF Nos. 105, 107. Upon careful consideration of the parties' arguments, the Court determines that summary judgment motions are inappropriate in these circumstances. The pre-motion conference currently scheduled for October 8, 2026 is hereby CANCELED. By no later than October 19, 2026, the parties are DIRECTED to submit a joint letter stating the estimated length of trial and the parties' availability for a trial during the months of April, May, and June 2027. The parties shall further indicate whether they request a referral to the District's mediation program or to the assigned Magistrate Judge for a settlement conference.
