ORDER GRANTING STIPULATION REGARDING CONSOLIDATION OF RELATED ACTIONS, SERVICE, AND STAY [37 ]by Judge Mark C. Scarsi: The following actions are hereby consolidated for all purposes, including pre-trial proceedings and trial, under Case No. 2:26-cv-04130-MCS-AYP (hereinafter, the "Consolidated Derivative Action"): Case Name Case Number Date Filed Davies v. Soon-Shiong et al. 2:26-cv-04130-MCS-AYP April 17, 2026 Mody v. Soon-Shiong et al. 2:26-cv-04245-MCS-AYP April 21, 2026 3. Every pleading filed in the Consolidated Derivative Action, or in any separate action included herein, must bear the following caption SEE CAPTION SAMPLE :" IN RE IMMUNITYBIO, INC. STOCKHOLDER DERIVATIVE LITIGATION - Lead Case No. 2:26-cv-04130-MCS AYP". All papers filed in connection with the Consolidated Derivative Action will be maintained in one file under Lead Case No. 2:26-cv-04130-MCS-AYP and all papers and documents previously filed and/or served in the Derivative Actions shall be deemed a part of the record in the Consolidated Derivative Act. Given the stay of the consolidated action and the possibility that additional derivative suits may be filed and consolidated, the Court reserves decision on all issues regarding the appointment of lead counsel. All proceedings in the Consolidated Derivative Action, including any obligation to respond to Plaintiffs complaints, all initial scheduling conference and case management conference deadlines, and all discovery and disclosure obligations under the applicable local and federal rules, are hereby stayed. For case administration purposes only, the Court directs the Clerk to remove the Derivative Actions from the Court's active caseload until further application by the parties or order of this Court.
