   PARTIAL STIPULATION OF DISMISSAL WITH PREJUDICE AS TO INDIVIDUAL DEFENDANT JAMES BARCHIESI, HIS COUNTERCLAIMS AGAINST PLAINTIFFS, AND THIRD-PARTY CLAIMS AGAINST LINDA ROTH: NOW, THEREFORE, in light of the foregoing, it is hereby STIPULATED AND AGREED by and between the undersigned attorneys of record for Plaintiffs and Defendant James Barchiesi that: (i) the claims in the above-entitled action as against Defendant James Barchiesi; (ii) any counterclaims asserted by Defendant James Barchiesi against Plaintiffs; and (iii) the Third-Party Complaint asse1ied byDefendant James Barchiesi against Linda Roth d/b/a Roth CPA, Roth Associates, and Roth Certified Public Accountants, are dismissed with prejudice pursuant to Rule 41(a)(1)(A) (ii) of the Federal Rules of Civil Procedure, with each party to bear its own costs and fees. IT IS FURTHER STIPULATED that this Stipulation may be executed in counterparts and by facsimile or other electronic means, each of which shall constitute an original and all of which together shall constitute one and the same instrument. The claims in the above-entitled action as against Defendant JamesBarchiesi; counterclaims by Defendant James Barchiesi againstPlaintiffs; and the Third-Party Complaint asserted by Defendant JamesBarchiesi against Linda Roth, Roth Associates, and Roth CertifiedPublic Accountants, are hereby dismissed with prejudice pursuant toRule 41(a)(2), as the parties have stipulated to the dismissal of theseclaims.
