MINUTES OF Final Pretrial Conference and Motion Hearing held before Judge Stanley Blumenfeld, Jr.: The Court heard argument from counsel on nonparty Sylvia Marks-Barnett's motion to quash a subpoena 110 . The Court orders that no later than 8:00 AM on 8/10/2026, Plaintiff may file an opposition, and Marsk-Barnett may file a supplemental brief, addressing the motion to quash. Defendants' third motion in limine 93 is granted in part as follows: Plaintiff may not characterize Defendants' conduct as "fraud," "payroll fraud," "timecard fraud," "wage theft," or similar terms implying intentional or criminal misconduct. This ruling does not preclude Plaintiff from testifying about what he observed, what he communicated to Defendants or his employer at the time, or what he believed at the time regarding Defendants' payroll or timekeeping practices. Defendant's fourth motion in limine to exclude damages evidence for past health and dental benefits, vacation and sick leave, and union dues 94 is granted without objection based on Plaintiff's agreement not to pursue these damages. The motion is denied as to evidence of back pay, for the reasons stated on the record. The Court defers ruling on the motion as to evidence of Plaintiff's pension benefits. No later than 8:00 AM on 8/10/2026, the parties shall file a joint statement setting forth their respective positions on whether the pension evidence should be excluded.
