TEXT ORDER - The Court is in receipt of Plaintiff's motion to remand based on the Commissioner's failure to appear within 60 days of the issuance of the summons in this matter. ECF No. 3. The Commissioner has since appeared and filed the administrative record, ECF No. 5, which Plaintiff has moved to strike. ECF No. 6. The Commissioner has also filed a letter explaining the delay in appearing was due in part to the government shutdown. ECF No. 7. Because Plaintiff's motion to remand essentially seeks a default judgment, as he asks the Court to grant the relief requested in his complaint, Federal Rule of Civil Procedure 55(a) requires that he first move for a default. As Plaintiff has not done so, and the Commissioner has now appeared and explained the reason for the failure to timely appear, Plaintiff's motion to remand and motion to strike (ECF Nos. 3, 6) are denied. Plaintiff shall have 30 days from the entry of this order to file and serve his opening brief on the Commissioner. So Ordered by Judge Claire C. Cecchi on 7/24/2026. (jl, )
