Case called. Cour heard argument from counsel. Parties agree that the language in the first sentence of the Notice of Proposed Settlement, should be changed from, "If you worked," to "You have been identified by Medminder Systems Inc. as an hourly employee who worked as a pharmacist or technician on the overnight shift." "You are entitled to payment from a collective action settlement if you opt in."
The Court ordered the record to reflect that the Court having good cause for the motion for approval of settlement payments, attorneys' fees and costs, approved the $160,000 settlement that was set forth in the settlement agreement. The Court approved the notice of settlement and opportunity to join collective action and claim form in the form attached to the motion, with the modification provided earlier. The Court approved payments of $2,500 to each of the named Plaintiffs, and Plaintiffs' request for one-third of the settlement funds for attorneys' fees, costs, and expenses. The Court's order is based on its incorporating the terms of the settlement agreement.
The Court dismissed the action with prejudice but retained jurisdiction over enforcement of the settlement agreement.
