Joint Preliminary Pretrial Conference Report
Joint Preliminary Pretrial Conference Report by Defendant Progressive Insurance (Armbrust, Alyssa)
Order on Motion to Bifurcate
** TEXT ONLY ORDER **This is a civil dispute about a machine that was damaged during its transport when it collided with an overhead railroad bridge and was exposed to rainfall. Defendant Progressive Insurance moves to bifurcate or stay this case to decide the insurance-coverage issues first. The court will DENY the motion. Progressive's request is not consistent with this court's general practice, see, e.g., Olejnik v. England, No. 14-cv-88-jdp, 2014 WL 12725827, at *1 (W.D. Wis. Aug. 8, 2014), and Progressive identifies no reason why the court should depart from its general practice in this case. Nothing prevents Progressive from moving for summary judgment on the coverage issues as soon as it has the information that it needs. Signed by District Judge James D. Peterson on 8/25/2026. (nln)
