TEXT ORDER - On June 25, 2026, the Court tentatively resolved a dispute that arose during the deposition of Defendant Hedgebeth, upon her objection to a line of questioning she argued rendered the deposition conduct in bad faith or in a manner that unreasonably annoyed, embarrassed, or oppressed her. The Court held that, on the limited record presented during the telephonic discussion, Plaintiff failed to meet his threshold burden to demonstrate the questions were within the broad scope of Rule 26 and tethered to the claims in his Complaint. Consequently, the Court granted Hedgebeth's request for an Order limiting the deposition under FRCP 30(d)(3)(A) and (B). However, for the reasons set forth during the call with counsel, that Order was without prejudice to Plaintiff's right to file a written letter brief with legal support for his argument to reopen Hedgebeth's deposition and seek answers to the questions at issue. Any such letter brief shall be filed on or before July 10, 2026 (6 pages; double spaced). Hedgebeth may file a letter brief in opposition on or before July 24, 2026 (same format). Failure to timely file the letter brief permitted by this text order will render this Court's decision on June 25 final and appealable to the District Court as of July 10.
