** TEXT ONLY ORDER ** In the last two business days, the parties have filed a handful of notices reporting on events outside of this litigation that impact its ability to proceed as scheduled. Of utmost importance, defendant Sunland Distribution of Florida, Inc. has provided notice that a petition was filed in Florida state court on September 4, 2026, commencing the assignment of benefits of Sunland's creditors. Dkt. 99 . As plaintiff Kathryn Harding points out, the resolution of this petition may impact whether certain claims may proceed against Sunland and who may bring those claims. Dkt. 100 . This, in turn, may impact this case, including whether plaintiffs may continue to pursue veil-piercing theories against Sunland. In light of this, it makes little sense to require the parties to press forward with the current schedule. Of particular note, the deposition of Sunland's president is scheduled for tomorrow. Dkt. 101 . The primary motivation for that deposition was to explore issues related to plaintiff's now-in-question veil-piercing claim. Also, plaintiffs' deadline to respond to the pending motion for partial summary judgment is set for September 18. That motion also primarily deals with veil piercing. The parties' and the court's resources would be better served on assessing the impact of the assignment proceeding before completing these tasks. For these reasons, the September 10 deposition is STAYED, the case schedule, including the summary judgment briefing schedule, is STRUCK, and all parties are ORDERED to provide the court their own status update within 30 days of this order. Each status update should address: (1) the posture of the Florida assignment proceeding, its projected timeline, and possible outcomes; (2) the impact of the Florida assignment proceeding on this case, including on the pending claims and the pending motion for partial summary judgment; and (3) the parties' proposed next steps for this case.
