MEMO ENDORSEMENT on re: 106 Letter filed by Gary Laverty, ENDORSEMENT: The Court thanks the parties for their joint status letter and wishes them luck in their upcoming mediation. But the Court needs clarity on how the parties intend to meet their pretrial deadlines, given the late mediation date. At the April 11, 2024, Pretrial Conference, the Court set August 2, 2024, as the deadline for the parties to submit their Joint Pretrial Order and directed the parties to propose a date for submission of the proposed Joint Pretrial Scheduling Order, which would contain the interim dates for pretrial exchanges. In this letter, the parties refer to submitting the Joint Pretrial Order by July 26, 2024, which is just a few weeks after their mediation. Thus, the parties are directed to clarify when they intend to submit the Joint Pretrial Scheduling Order in light of the pending mediation. Regardless, the Court expects the parties to submit their Joint Pretrial Order by no later than August 2, 2024. Failure to do so will risk adjournment of the trial, currently scheduled to begin on September 16, 2024.
