STIPULATION AND ORDER OF DISMISSAL: IT IS HEREBY STIPULATED AND AGREED, by and between the nndersigned, that, as the parties have agreed to binding arbitration, and pursuant to Federal Rule of Civil Procedure 41(a)(l)(A)(ii), Plaintiff, KATINE PAGONES, hereby voluntarily dismisses and discontinues all claims against Defendant JEROME D, NOMAKEO, in the above proceeding with prejudice. Notwithstanding the dismissal of this action in accordance with this agreement, the District Court shall continue to retain jurisdiction over this action for the purpose of enforcing the terms of the arbitration of this matter and/or settlement agreement reached between the parties and set forth in the Stipulation of Dismissal executed by the parties in this matter.
