ORDER - In accordance with that ruling (Dkt. 135 ) and the mandate of the Ninth Circuit (Dkt. 138 ), the Court hereby: (1) vacates the portion of its March 31, 2019 Order (Dkt. 120 ) granting summary judgment to the EPA, and (2) vacates entry of judgment in EPA's favor (Dkt. 121 ). Further, based on the Supreme Courts decision, the Court: (1) grants summary judgment in favor of the Sacketts' because any wetlands on the Sacketts property are not "waters of the United States" under the Clean Water Act; and (2)enters judgment for Plaintiffs consistent with the foregoing.
