ORDER ON CROSS MOTIONS FOR SUMMARY JUDGMENT Signed by Judge Tana Lin. It is hereby ORDERED:(1) Plaintiff's Motion for Partial Summary Judgment (Dkt. No. 17 ) as to Counts 1 and 2 is GRANTED, and DENIED as to Counts 3 and 4. The Court FINDS Defendant violated 15 U.S.C. § 1692e and 15 U.S.C. § 1692f.(2) Defendant's Motion for Summary Judgment (Dkt. No. 20 ) is DENIED.(3) The Parties SHALL file a joint status report stating whether they wish the settlement conferen ce and/or mediation deadlines to be reset, any modification from the original estimate of number of trial days requested, and any dates for which they are unavailable for trial through December 2027. If the Parties have previously attempted private mediation and believe a settlement conference with a magistrate judge may be productive, they may include this request in the report. The report SHALL be filed within fourteen (14) days of this Order. (KMP)
