Text Order
TEXT ORDER: The Court has reviewed Plaintiffs' response to the Notice of Call for Dismissal pursuant to Federal Rule of Civil Procedure 4(m). D.E. 15 . In light of Plaintiffs' representations regarding their efforts to serve Defendant, including their retention of an investigator and further attempts to confirm and serve Defendant through its registered agent, the Court will GRANT Plaintiffs a final extension to effectuate service. It is ORDERED that Plaintiffs, on or before August 11, 2026, shall either: (1) file proof that Defendant has been properly served under Federal Rule of Civil Procedure 4(h), New Jersey Court Rule 4:4-4, or any other applicable method of service (e.g., N.J. Stat. Ann. § 42:2C-17); or (2) file a renewed motion for alternative service. Any renewed motion for alternative service shall comply with Local Civil Rule 7.1 and must include a supporting brief, a proposed form of order, and a sworn affidavit of diligent inquiry identifying the specific efforts made to locate and serve Defendant. Any renewed motion must also identify the precise alternative method of service requested and explain why that method is reasonably calculated to provide Defendant with notice of this action and an opportunity to respond. For the avoidance of doubt, nothing in this Order authorizes alternative service or deems Plaintiffs' prior attempts at service sufficient. No further extensions will be granted absent extraordinary circumstances. If Plaintiffs fail to comply with this Order, this action may be dismissed without prejudice under Rule 4(m). So Ordered by Judge Evelyn Padin on 7/10/2026. (bt)
