RECOMMENDATION OF THE MAGISTRATE JUDGE: it is the RECOMMENDATION of the undersigned Chief United States Magistrate Judge that Southeastern and 1716's Motion to Dismiss (Doc. 32 ) be GRANTED pursuant to Rule 12(b)(5) and/or Rule 12(b)(6) and that the claims against them be dismissed without further opportunity to amend or perfect service. The undersigned also RECOMMENDS that Qashou's claims against Skybar be dismissed under Rule 4(m) without a further extension of time to perfect service and that his motion to reissue the summons for Skybar (Doc. 40 ) be DENIED as futile based on the amended complaints failure to state a Title III ADA claim against Skybar.
