   MEMORANDUM ORDER - Having considered Ms. Bardot's report and recommendations, the Court is satisfied that H.N.'s interests are adequately protected in this matter generally. The Court is further satisfied that H.N.'s parent, counsel, and guardian ad litem all endorse the proposed Settlement Agreement as promoting the best interests of H.N. The Court therefore FINDS that the Settlement Agreement is in H.N's best interest. It is understood and agreed that Matthew Nugent, the father and next friend of H.N., is authorized to enter into the Settlement Agreement on Plaintiff's behalf. The proposed Settlement Agreement, enclosed, is hereby APPROVED AND CONFIRMED. Defendant and its insurer are forever released and discharged from any further liability to H.N. and his parents, guardians, and custodians for damages arising out of the subject accident occurring on September 29, 2023. Pursuant to Ms. Bardot's recommendation, the $157,500.00 settlement amount SHALL be paid to Silek Law Group, P.C., for distribution as set forth herein. The purposes of this action being accomplished, the following outstanding motions in this matter are DENIED AS MOOT: (i) Joint Motion for Discovery (ECF No. 28 ); (ii) First Motion to Quash Subpoenas for Records of H.N. (ECF No. 29 ); (iii) First Motion to Quash Subpoenas for Records of Matthew Nugent (ECF No. 30 ); and (iv) Motion to Appoint Guardian Ad Litem and Approve Infant Settlement (ECF No. 41 ). The Court further orders that this action be DISMISSED WITH PREJUDICE. The Clerk is DIRECTED to close the case and send a copy of this Order to all counsel of record and Guardian Ad Litem, Ms. Heather K. Bardot, Esq. See Order for details.
